BY ACCESSING OR PARTICIPATING IN THE BMJ REWARDS TOKEN PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR PARTICIPATE IN THE BMJ REWARDS TOKEN PROGRAM.
These BMJ Rewards Token Program Terms of Use (“BMJ Rewards Terms”) complement and incorporate by reference the Bitcoin Market Journal Terms of Service (“TOS”), You agree that we may provide updates, notices, disclosures and amendments to these BMJ Rewards Terms, and other information relating to the BMJ Rewards Token Program (“BMJ Rewards”) by electronic means, including posting such information and materials online at https://www.bitcoinmarketjournal.com/rewards-terms. In the event of any conflict between the TOS and these BMJ Rewards Terms, the BMJ Rewards Terms shall control.
ADDITIONAL TERMS
These BMJ Rewards Terms apply to your access to, and participation in, BMJ Rewards which is operated by Media Shower, Inc. or its respective subsidiaries, licensees and affiliated companies (collectively, “Media Shower”). These BMJ Rewards Terms do not alter in any way the terms or conditions of any other agreement you may have with Media Shower for other products or services.
CHANGES TO TERMS
Media Shower reserves the right to change or modify these BMJ Rewards Terms or any policy, FAQ, or guideline pertaining to BMJ Rewards, in whole or in part, at any time and in its sole discretion. Any changes or modifications will be effective immediately and may be posted to https://www.bitcoinmarketjournal.com/rewards-terms, so please check back from time to time. You waive any right you may have to receive specific notice of such changes or modifications, and your continued access to or participation in BMJ Rewards following any such changes or modifications confirms your acceptance. If you do not agree to these BMJ Rewards Terms, you must stop accessing and participating in BMJ Rewards.
AGE OF PARTICIPATION; SANCTIONS; PRIVACY POLICY
BMJ Rewards is not targeted towards, nor intended for use by, minors, in accordance with the provisions of our TOS.
As a U.S. company, Media Shower must comply with U.S. sanctions laws and may not do business with any person or organization subject to U.S. sanctions, whether individually identified or located in a region subject to U.S. sanctions. The people and organizations subject to sanctions are listed on the Office of Foreign Asset Control’s (“OFAC”) Specially Designated Nationals and Blocked Persons List (“SDN List”), and the SDN List now includes certain digital wallet addresses. The countries and regions subject to absolute U.S. sanctions are currently the Cuba, North Korea, Iran, Syria and the Crimea, Donetsk and Luhansk regions of Ukraine the (“Sanctioned Countries”), although this is subject to change at any time. The U.S. has made it illegal to deal with people, companies., and digital wallet addresses (i) on the SDN List, or (ii) located or organized in Sanctioned Countries, in each case regardless of whether they are sending or receiving funds or other assets (digital or fiat) or services. We will not be able to provide BMJ Rewards, BMJ Tokens, or any other service to anyone we identify as a U.S. sanctions risk.
Our Privacy Policy is incorporated into these BMJ Rewards Terms and also governs your participation in BMJ Rewards. Please read the Privacy Policy carefully to understand how Media Shower collects, uses and discloses information about customers, how to update or change your personal information, and how we communicate with you.
ABOUT BMJ REWARDS
BMJ Rewards is one way in which Media Shower endeavors to reward and thank loyal customers for patronizing our business and purchasing Media Shower products. BMJ Rewards members are able to earn and accumulate BMJ-labelled, fungible tokens minted by Media Shower that are ERC-20 compatible (“BMJ Tokens“) that can be redeemed exclusively at https://www.bitcoinmarketjournal.com/rewards (“Rewards Website”) for merchandise, experiences, and anything else we may choose to offer from time to time. Media Shower will burn each redeemed BMJ Token.
JOINING BMJ REWARDS
To join BMJ Rewards, go to the Rewards Website and follow the prompts to link join BMJ Rewards. In order to receive your BMJ Tokens, you must also connect your BMJ user account to your digital wallet. You must have a compatible digital wallet in order to take advantage of BMJ Rewards, and may need to download a third-party digital wallet system if you do not already have one. We will not be liable for any loss or damage associated with your third-party digital wallet.
EARNING BMJ TOKENS
BMJ Tokens are earned by subscribing to our BMJ Premium membership, and as a result of engaging in certain other activities that we may identify from time to time either as permanent enhancements to BMJ Rewards or as a distribution for promotional purposes. We will credit you with BMJ Tokens on a monthly basis on the first day of the month at a rate of ten (10) BMJ Tokens each month your BMJ Premium subscription is active, although this is subject to change at any time, as described below.
BMJ REWARD TOKEN EXPIRATION
Unless otherwise noted, BMJ Tokens do not expire.
REDEEMING FOR REWARDS; USE OF BMJ TOKENS
BMJ Tokens may be redeemed exclusively for complimentary items available on the Rewards Website. You may be required to cover the cost of shipping, depending on your location.
BMJ Tokens are intended for personal, consumptive use only. By participating in BMJ Rewards and earning BMJ Tokens, you understand, represent and warrant that:
- You are accumulating BMJ Tokens solely for consumptive use in connection with the Rewards Website;
- You are not acquiring BMJ Tokens as an investment and have no expectation of economic benefit or profit as a BMJ Token holder;
- You are earning BMJ Tokens for your own consumptive use and not with a view to sell or otherwise distribute BMJ Tokens to anyone else;
- You will not acquire any equity or other ownership interest in Media Shower by virtue of owning BMJ Tokens; and
- You will not portray BMJ Tokens or BMJ Rewards as an investment or an opportunity to obtain an economic benefit or profit;
- BMJ Tokens were created for people to enjoy by collecting and redeeming on the Rewards Website, not as a financial instrument or investment;
- Media Shower makes no promises or guarantees regarding the current or future value of BMJ Tokens;
- If you purchase BMJ Tokens outside of BMJ Rewards, you do so at your own risk – Media Shower cannot and does not guarantee that such BMJ Tokens will have any value on the Rewards Website or any other venue;
- Your acquisition and use of BMJ Tokens, and participation in the BMJ Rewards Token Program, complies with applicable laws and regulations in your jurisdiction, including without limitation, legal capacity to contract, and legal and regulatory restrictions;
- You will not use BMJ Tokens for any illegal purpose or for any kind of wagering, betting or gambling, either within or without the US; and
- You are solely responsible for paying any taxes owed for the distribution or redemption of BMJ Tokens, and will comply with applicable tax obligations arising from your acquisition or use of BMJ Tokens.
ADDITIONAL BENEFITS OF BMJ REWARDS
As a BMJ Rewards member, you may be eligible for additional benefits such as early or extended access to certain promotions and offers or member-only discounts. Each offer will specify how BMJ Rewards members may take advantage of such promotions and offers.
OTHER IMPORTANT INFORMATION YOU SHOULD KNOW
There are no participation or membership fees associated with BMJ Rewards. BMJ Tokens accrued in connection with BMJ Rewards are promotional, have no cash value and cannot be redeemed for cash. In addition, your redemption of BMJ Tokens accrued in connection with BMJ Rewards cannot be combined with any other offers or discounts, unless otherwise expressly indicated by Media Shower.
Your BMJ Tokens and BMJ Rewards account are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You may have only one (1) BMJ Rewards account that is personal to you.
Without notice to you, Media Shower reserves the right to terminate your account and/or your participation in BMJ Rewards if Media Shower determines, in its sole discretion, that you have violated these BMJ Rewards Terms or that the use of your BMJ Rewards account is unauthorized, deceptive, fraudulent or otherwise unlawful. Media Shower may, in its sole discretion, suspend, cancel or combine BMJ Rewards accounts that appear to be duplicative. In the event that your participation in BMJ Rewards is terminated, no further transactions with your rewards account will be permitted.
Media Shower reserves the right to change, modify, discontinue or cancel BMJ Rewards or any part thereof, at any time and in its sole discretion, without notice to you.
SEVERABILITY
If any provision or part of a provision of these BMJ Rewards Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these BMJ Rewards Terms and does not affect the validity and enforceability of any remaining provisions.
